A man appealed against an interim divorce judgment granted to his wife, on the grounds that she was a lesbian who wanted to divorce him to live with her female partner.
He was of the belief that if his appeal was granted, his wife would return to him.
However, his appeal was dismissed by Justice Choo Han Teck on 23 July, who commented that it was too late.
Justice Choo also added that for the man, love was no longer on the cards.
The couple got married in 2009 and they had a daughter and son in 2011 and 2013 respectively.
THe wife claimed that their marriage broke down in 2013.
She then left their matrimonial home in 2019 and filed for divorce against him in 2020, citing unreasonable behaviour.
The husband didn’t file his defence and the court passed an interim judgment in her favour in November 2020.
The husband applied to rescind the judgment but was dismissed.
He then appealed against the dismissal, on the basis that his wife didn’t reveal that she was a lesbian who left their marriage to live with her female partner.
He believed that the interim judgment wouldn’t have been granted if the court knew of the matter.
Justice Choo said that there was no merit to his argument, and that it “made no legal sense”.
He also added that “from the evidence before me, (it is) unlikely to achieve anything but a prolongation of mutual grief.”
“It is too late now.”
The custody of the children is also yet to be decided, and the children are living with their father at the moment.
