Yap Pow Foo, 47-years-old, is being accused of breaking into a woman’s home and raping her – he is facing one count of rape and one count of housebreaking, the High Court heard on 28 June.
He allegedly took the keys to the women’s home from under her door and entered her unit to rape her on 30 January 2017.
Yap is contesting his charges on the notion that the intercourse that he had with the 39-year-old alleged victim was consensual.
The alleged victim and 5 of her friends were drinking and playing mahjong at her home on 29 January 2017 during a Chinese new year celebration.
They then went to a karaoke lounge in Bugis after dinner where she drank some more alcohol when Yap, who is a friend of one of the woman’s friends, joined them towards the end of the night.
The alleged victim was already drunk at that point in time.
Yap offered to drive them home at about 12.45am on 30 January 2017, stopping at the woman’s condominium first.
The woman was seen in CCTV footage appearing to be unconscious and had to be lifted home by two male friends as Yap found his way to the unit separately.
The three of them then left her home and locked the door behind them, with one of the friends slipping her house key underneath her door.
Yap then returned to the condo by himself at about 3am.
Deputy public prosecutor Chong Kee En said that the evidence shows that Yap broke into the woman’s home and raped her while she was unconscious.
She had allegedly woken up and found him on top of her, and she later called the police at about 4.10am to report the alleged rape incident.
Yap was then arrested later that afternoon and his semen was found on samples that were taken from the woman’s body and her shorts.
According to a toxicology report, the woman would’ve had 144mg of alcohol per 100ml of blood at the time of the purported incident, which possibly indicates that she was mentally and physically impaired by the alcohol.
Accidentally “slipped” into victim
The court also heard that Yap told a police officer that he had undressed the woman, who was awake at the time and laid down beside her, before accidentally “slipping” into her.
Yap said that the woman told him “don’t want”, and he had told the police officer that the woman was hugging him at the karaoke lounge and sending him “signals”.
He also further claimed that the woman had invited him to her home and provided him with her condo access PIN, as well as giving him her phone number.
Yap also told the police officer that he had returned to the woman’s hope to see if there was a chance he could sleep with her.
