Breaking up after BTO
Dear All,
I need some advice, I have recently broken up with my partner.
Currently we have a BTO going but my partner wants to withdraw from it and is requesting us to go HDB to get back our stamp duty. But I really wants the house.
As he/she doesn’t have CPF back then I paid the full 10% CPF deposit for the house & we only shared the cost for the stamp duty.
My partner wanted the stamp duty refund so much that he/she went to made a police report against me for not following the request to proceed to cancel the HDB.
Q1. I read somewhere that it is possible to change the ownership to my future partners (if any) name? is this true?
Q2. If my partner insist on cancelling the BTO to get the stamp duty & brought me to court for this. Can he/she actually win the case and kick my rights to the BTO?

- I’ve had a friend been in a similar situation before. You can swap out your ex’s name but you need to have a new partner that you want to have the BTO with. Also, this is on a case by case basis up to the discretion of HDB. Ie for my friends case, couple was on a break and the guy had a one night stand with my friend and ended up getting pregnant and since a child is already on the way and they are getting married, HDB allowed the swap
- Your argument seems to only revolve around the fact that you paid your 10% and you really want the flat but that’s not how the world works.
- I mean, I’m not an expert for HDB but for Qn 1, the BTO policy is for couples who are going to be married. that’s literally the point of BTO. you have broken up, you currently have no partner, you (i assume) r not gonna be married anytime soon. You cannot just make up some exception about changing ownership in respect of a non-existent partner because you ‘really want the house’. Yeah no shit, there is a shortage, many many couples (who have not broken up) really want the house.
- I don’t think you have a choice in any of this. If ur not gonna get married. You can’t have the house. Your only option left is to make sure she pays half of the deposit
