Knowing that his daughter had been molested, Zhang Moujia, a 35-year-old man from Baishui County, Weinan, Shaanxi Province, wounded the molester. The case was later classified as a second-degree assault.
Recently, the China authorities released a media release stating their decision of not to prosecute the father.
The Baishui County Procuratorate believes that Zhang Moujia voluntarily surrendered, confessed the crime truthfully, voluntarily pleaded guilty and accepted the punishment and that the victim Zhang Mouyi had serious faults, and decided not to prosecute Zhang Moujia after comprehensively considering the antecedents and consequences of beating others and the degree of harm.
Zhang Moujia, male, born in 1986, with junior high school education, where his household registration is located, is a farmer from a town in Baishui County, Weinan City, Shaanxi Province.

The procuratorate examined and found out that at 11 am on June 12, 2021, after learning that his daughter was molested by Zhang Mouyi, Zhang Moujia rushed to Zhang Mouyi’s house, kicked her to the ground with his feet, and again
He punched his head two or three times with his fist, and hit his head with a porcelain bowl.
The facts of the crime are clear, and the evidence is reliable and sufficient. His behaviour violated the provisions of Article 234 of the Criminal Law of the People’s Republic of China. He should be investigated for criminal responsibility for the crime of intentional injury.
However, the procuratorate believes that since Zhang Moujia voluntarily surrendered and truthfully confessed his crime, he surrendered himself, and he voluntarily pleaded guilty and accepted punishment. The victim Zhang Mouyi was at serious fault, and comprehensively considered the antecedents and consequences of beating others, the degree of harm, etc. According to the provisions of Paragraph 2 of Article 177 of the Criminal Procedure Law of the People’s Republic of China, it was decided not to prosecute Zhang Moujia.
