CONTRACT BOND JOB AFFECTING MAN’S MENTAL HEALTH, SCARE NEED COMPENSATE, HOW AH

Just a question. I’ve signed a contract bond with the company but do I need to pay one month’s salary if resign before the contract finish?

This is because the job has been affecting my mental health and body so I’m planning to resign. But the contract states that ‘by signing this letter, it is agreed that employment will be bonded for a period of 3 years. You understand that by accepting this bond agreement, you will be required to continue in employment until the date specified above.

If for any reason, you terminate the employment before the bond date is reached, you will need to pay the cost of a full month’s salary. Failure to repay the amount for breaching the agreement will result in the remaining balance being deducted from your final pay or legal action will be taken against you.

The short answer is Yes. You need to pay when you break contract. If they terminate you, they have to pay. Contract is two ways.

What if they terminate you instead? Maybe no need pay. You just need to every week see the cheapest doctor/polyclinic get 1 week MC say you diarrhea or u went near covid patient or u tc of sm1 with small pox or hfmd. N keep going toilet break all the time. Surely they can’t go toilet cubicle look at u poo right? I learn this from my 8yr old. Dun want study every period go toilet and everyone had to wait till he comes out. They gave up on getting him to go class. N if he does go class he stare at ceiling fans.

What if the job is giving my constant headache & stress, do I have to continue finish the bond?

It’s a legally bonding contract, so legally you have to abide. But you can go to court to dispute it, albeit with cost worth more than a month salary.

What to do

Nope, that contract is not going by MOM law. You can go ahead and resign, there are many chinese-china owned company that does that. It’s illegal.

To be bonded, they will pay for your school fees, are they? Because bonded on knowledge transfer is not binding.

Just wait till your salary for the month worked and then just leave.

It’s a one-sided contract drafted by the company as it would be considered an unfair employment- MOM will side with you. (Practically the contract that you sign will be voided and unenforceable) So what the company will do is, after you decide to leave, they will use scare tactics by using a lawyer to send LOD (sometimes up to 3) You can ignore it. Because they won’t really pursue to court , not worth their time.

Usually companies who force you to sign such documents, don’t have a qualified HR. (Certified/ Diploma or degree) as a qualified HR will be able to advise the employer of such unfair and illegal practices .

Also don’t pay them a single cent, usually the HR person (from those china companies), they take commission from what you pay back, and those unlawful binding wouldn’t be in the contract at all.

Worst case:

What you can fight for is you signed under duress and or there was a misrepresentation of the contract.
