Hi, need help to make somebody famous, ah beng sales manager thinks he’s above the law.
On 15th Apr 2018 me and my then wife went to your Sungei Kadut branch and was served by your staff Shirley. After browsing awhile, your Showroom Manager Eric Teng took over and offered us to “save money” by offering us a ‘flexible’ package. We paid the deposit for more than 50% of the whole package and went off.
A month later my wife decided to leave the marriage and we agreed to ask for a refund from Nova Furnishing Pte Ltd since the HDB is cancelled and nobody else needed the furniture.
Called to ask for a refund and Mr. Teng said it was stated there is no refund. I remember very vividly that it was not mentioned to us when we were at the showroom. Then when i checked, to my surprise, there was a stamp over the signature and handwritten comment that stated “No refund exchange or cancellation”.
This was clearly stamped and written AFTER we made payment and signed on the invoice. The stamp mark was over the signature.
Mr. Teng was very smug and challenged me to go ahead and lodge a complaint to CASE or Small Claims. Confidently brushing me off by saying Nova have their in house lawyers and he is very familiar with the law, knowing how to “play this game”.
Eric then tried to unnerve me saying “wives are meant to be pampered, not to divorce”. I shall not stoop to uncultured petty comments and ended the meaningless tele-conversation.
Fast forward to Sep after being caught up with work, i finally managed some time to lodge a claim thru Small Claims. The Notice notice to attend court on 26th Oct was sent out but Nova’s rep didn’t turn up and I wasted a trip. I was forced to mail out a registered mail copy of the Notice for 7th Nov.
When 7th Nov came, no rep appeared and the judge awarded me with the Order for Nova Furnishing Pte Ltd to pay me by 7th Dec. To my surprise, this time the rep did something and asked for a Set Aside Order so I have to attend a hearing on 17th Dec.
I went down on 17th Dec and found that there was no rep. The judge then gave the final judgement to award me with the case, stating that the previous order still stand and that Nova Furnishing Pte Ltd MUST pay me back my deposit and administrative fee of $10.
Mr. Teng then texted me and asked me to wait and see if he can successfully appeal for the hearing because he was more than 20 mins late for the hearing. I finally saw a rep from Nova and it was none other than Mr. Eric himself.
Again smugly he said that there’s no need to pursue further as other customers also didn’t get their money back. He is very familiar with this “game” and i don’t have to think that I’ll have a chance to even “smell” my money.
I guess this law savvy salesperson must really know how to “play the game” since he thinks he’s above and beyond the law. Wonder why he didn’t become a lawyer?
I would like to urge Nova Furnishing Pte Ltd to make the payment back to me by end of 2018, if not i shall bring my court order and take further enforcement actions. I do not believe that the sentiment of Mr. Eric Teng is shared by the management of Nova Furnishing Pte Ltd and it seems like he’s trying to save his commission from being crawled back by the company.
