WORKERS’ SALARY & CPF NOT PAID, CHASE AFTER H.R BUT THEY KEEP GIVING EXCUSES

Should my sister report her company to MOM?

Hello guys! I would like to seek some advice for my sister.

I can’t give much details as I fear that my sister would get recognised. My sister’s company has not been paying them for a month. Their CPF and salary for July has yet to be credited. When her colleagues try to chase the HR, they kept giving empty promises and mentioned that their pay will come in by latest next week. They also kept coming up with excuses. Lately, the boss emailed them and mentioned that they are facing some financial difficulty (can’t say too much) and their pay will be in latest the end of next week.

This Is the second time the company paid my sister late. The first time it happened, the management handled it pretty badly and a good amount of her colleagues resigned/got asked to leave cause they made a report to MOM. They were also promised a bonus but they never recieved it after the first incident.

I like to know if I should convince her to report to MOM or should she just wait it out till she get her salary? My sister has been contemplating if she should report to MOM but she fears that it will ruin the relationship with the boss as the report is not anonymous and also, she would like to leave the company on a good note.

Always start by exploring the internal options: If the HR staff in her company is unresponsive, she should escalate the matter to the HR manager and above. If the entire HR department is unhelpful, she can consider approaching the HR department of the parent company.

Your sister needs to review her employment contract, specifically focusing on the clause related to salary payments. Does the clause state “payment will be made monthly”? If it does, the company has breached the contract, and your sister has every right to report this to MOM.

If the internal options don’t yield results, advise her not to resign that soon. It’s crucial to preserve all information and evidence, including screenshots of her colleagues’ emails to HR requesting a response regarding the promised salaries and bonuses.

Advise her to file a claim for unpaid salaries on the TAPM website (https://www.mom.gov.sg/employment-practices/managing-employment-disputes). The application fee is approximately $10.

You’re correct; SingPass and NRIC will be used during the claim submission. However, the concern is that if your sister is subsequently terminated, she can add on to her claim in point (4) and inform MOM of wrongful termination, as she is exercising her employment rights.
